PROFESSOR Lovemore Madhuku's National Constitutional Assembly (NCA) on Friday filed an urgent High Court application seeking the setting aside of the toll fees increase which was effected last week.
The opposition party argues in its court papers that Transport Minister Obert Mpofu used the wrong instrument in effecting the increase.
The NCA becomes the second organisation that has approached the High Court in an attempt to force the government to reverse the unpopular 100 per cent toll fee increase.
ZLHR argued that the government was in breach of Section 68 of the Constitution which demands that the state consults citizens on such issues.
“The statutory instrument used by the minister is invalid and that chapter does not give him the authority to increase toll fees and besides he never consulted anyone,” Madock Chivasa, the NCA spokesman told NewZimbabwe.com Friday.
“As a people-oriented party, we believe that people are being robbed of their hard-earned cash and they do not deserve to be abused in that manner hence the urgent High Court application.”
