Adultery claim: Magaya responds

EMBATTLED PHD Ministries leader, Walter Magaya, has scoffed at adultery claims made against him by Food World manager, Denford Mutashu, who insists the youthful prophet was bedding his wife.

Mutashu has since filed a $500,000 claim against the charismatic man of cloth for emotional damages.

He insists Magaya fell madly in love with his wife Nomsa Ruvazhe, a PHD follower, under the guise of offering her spiritual assistance June this year.

Mutashu further claims the miracle church leader accommodated his wife over three days in one of his Harare lodges without his knowledge and is adamant that is when the alleged affair sparked and blossomed.

But responding to the claims, Magaya, through his lawyers, implored the courts to dismiss the case for being speculative. He said his accuser had failed to supply specific details as to how he was bedding his wife.

"Whilst making a claim for adultery damages, Plaintiff does not allege, plead or place reliance upon real or alleged sexual encounter between Defendant and his wife," reads the court response, filed Thursday by his lawyers, Rubaya and Chatambudza legal practitioners.

In his affidavit, Mutashu claims he was armed with video footage during which Magaya is owning up to his ungodly acts and conceding to end the relationship.

He says he also had a printout of the text messages that were exchanged by the lovebirds including another explicit one in which Magaya remarks to Ruvazhe that she was sexually attractive.

He proceeds to claim the prophet blessed his wife with the latest version of a Toyota Mark II worth $10,000.

But Magaya responds: "No date and place of any sexual encounter has been set out as is required by law, and, generally no particulars such as would support the commission of adultery have been set out or relied upon in the entire declaration.

"The claim is consequently set in vacuo, incompetent and devoid of any recognised legal basis. Please take notice that defendant applies to strike our Plaintiff's declaration on the grounds that, it does not constitute a pleading …

“It seeks to tell a story, it contains evidence which evidence is at any rate speculative, it is irrelevant, superfluous, verbose and unnecessarily argumentative."

Ruvazhe, on her part, has since denied the love relationship, further claiming her husband was deliberately trying to fleece the rich prophet using her name.

The case on Wednesday took a turn for the astonishing when it sucked in former ZIFA CEO Henrieta Rushwaya who is now one of Magaya's employees.

Magaya turned his employee to the police claiming she had been suspiciously encouraging him to pay the demanded cash as a way of silencing Mutashu.
